For children. For families.
For their future.
A birth injury claim can involve complex obstetric, neonatal and neurological evidence. The question is not simply whether something went wrong, but whether substandard care caused preventable harm.

JRR Attorneys focuses on personal injury and medical negligence litigation. We obtain and analyse medical records, work with leading medico-legal experts and build the evidence required to test negligence and causation. Where a viable claim exists, we pursue compensation for the child’s proven lifelong needs.

“Parents often come to us not knowing whether negligence occurred. Our job is to investigate the medicine, test the evidence and give them a clear legal answer.”

Birth injury expertise

Cases we investigate.

Not every poor outcome is negligence. We investigate whether the care before, during or after birth fell below the required standard and caused injury.

01

Cerebral palsy

Claims involving avoidable brain injury, oxygen deprivation, delayed intervention
or failures during labour and delivery.

02

HIE & birth asphyxia

Hypoxic-ischaemic encephalopathy and brain injury associated with inadequate oxygen supply before or during birth.

03

ROP & infant blindness

Retinopathy of prematurity claims involving screening, monitoring, oxygen management or delayed treatment.

04

Jaundice & kernicterus

Severe hyperbilirubinaemia and neurological injury where jaundice was not
adequately identified, monitored or treated.

05

Delayed Caesarean section

Cases involving signs of foetal distress where escalation or emergency delivery may
have been unreasonably delayed.

06

Neonatal negligence

Serious injury arising in neonatal or NICU care, including monitoring failures, infection and other avoidable complications.
JRR court success · Cerebral palsy

A case pursued all the way to the Constitutional Court.

JRR acted for the mother of a child with cerebral palsy after obtaining the available records and instructing specialist medical experts. The hospital and MEC for Health appealed the High Court outcome.
The Constitutional Court ultimately confirmed the client’s victory, with the hospital ordered to meet 100% of the proven damages.
Another JRR result

Retinopathy of prematurity.

A child who became blind shortly after birth had previously been advised by another firm that the claim had no merits. The family approached JRR for a second opinion.

After examining the records, taking a detailed history and conducting further investigation, JRR pursued the matter in the High Court.

The case proceeded through a hard-fought trial and JRR’s client succeeded. It is a useful example of why serious neonatal cases require careful expert investigation rather than assumptions about whether a claim is viable.
